Does your LLC need its own EIN?
Begin with four questions: Is the LLC legally formed? Does it have one member or more than one? Has it elected a federal classification other than the default? Will it have employees or owe a tax for which the LLC must be separately identified? The answers explain more than the phrase “LLC” by itself. A disregarded single-member LLC without employees or applicable excise liability generally does not need a separate EIN for federal income-tax purposes. It may still obtain one for a legitimate bank or state requirement, and an election or later payroll can change the analysis.
A domestic LLC with two or more members is generally treated as a partnership for federal income tax unless it elects corporate treatment. Form the LLC before applying

Special ownership arrangements can affect default treatment. For example, an LLC owned by another entity is not identical to an individually owned LLC. Do not infer the answer from a generic online checklist when the actual owners and elections are different.
Which number is used for which purpose?
For federal income-tax reporting by a disregarded single-member LLC, the owner generally supplies the owner’s TIN. The IRS specifically explains that an individually owned disregarded LLC’s Form W-9 should give the owner’s SSN or EIN, not the LLC’s EIN. That rule should not be copied to a multi-member LLC or a company with corporate treatment. For employment taxes and certain excise taxes, a single-member LLC can be treated as a separate taxpayer and use its own name and EIN. A bank or state authority can have a separate documentation request even where federal income-tax reporting uses the owner.
Obtaining an EIN does not make the LLC’s number correct for every document. Match the identifier to the actual reporting purpose; ask the receiving institution what it needs and verify the federal instructions when a tax form is involved.

LLC versus corporation or S corporation treatment
An LLC’s EIN request identifies the taxpayer; it does not file a federal classification election or elect S treatment. A corporation formed under state corporate law is another legal structure. Search assignment notices and tax records for an existing LLC EIN. A changed address or business name is ordinarily a record-update question rather than an automatic second EIN. A tax election alone may leave the same LLC with its existing number. Terminating an LLC and forming a new corporation or partnership can be a different case. After assignment, retain the notice and separately review payroll, income reporting, elections, state requirements, and licenses.
Illustrative scenario: One person forms an LLC with no employees or relevant excise tax and keeps default disregarded treatment.
